TJSP's State Program to Combat Overindebtedness has the support of the credit bureau sector
Initiative aims to strengthen conciliation and mediation in disputes between over-indebted debtors and their creditors
São Paulo, December 19th 2023: As a result of the São Paulo Judiciary's coordination with executive branch bodies, retail companies, credit analysis companies, financial institutions and public service concessionaires, the State Program to Combat Over-indebtedness was created. digital platform developed by the TJSP, In this way, individual debtors, sole traders and micro-entrepreneurs in the state of São Paulo can try to reach agreements with creditors - private companies, financial institutions or public service concessionaires - to pay their debts.
The National Association of Credit Bureaus (ANBC) celebrates the creation of the TJSP's program and points out that the initiative is in line with the bureaus' aims of combating over-indebtedness, promoting financial education and social welfare.
The program will have the support of the credit bureaus Boa Vista, Quod, Serasa and SPC Brasil, as Institutional Partners of the São Paulo Court of Justice, to, with the support of the National Association of Credit Bureaus (ANBC), publicize the program and its benefits in strengthening and using conciliation and mediation to find solutions to disputes between over-indebted debtors and their creditors, as established by Law 14.181/21.
To join, those interested need to fill in a form and include proof of their debts. The request for mediation will then be forwarded to the Judicial Centre for Conflict Resolution and Citizenship (Cejusc) closest to the applicant's home and then a specialized team will contact the creditor companies to schedule a conciliation session, accompanied by a conciliator who specializes in cases of over-indebtedness. If an agreement is reached, it will be ratified by the magistrate of the unit, becoming valid as a judicial enforcement order.

For this reason, ANBC is committed to publicizing the initiative, in its various phases, as well as its results. The TJSP's State Program to Combat Overindebtedness aims to facilitate the credit recovery process and contribute to more conscious consumption,” says Elias Sfeir, president of ANBC.
The program accepts pre-proceedings or ongoing cases - in which case the court proceedings will be suspended for the conciliation attempt. The next phases of the program will be announced by the TJSP in early 2024.
